Description
The appellant imported a cargo of 75 cartons of electric car jack from China by a bill of lading, and the consignment was shipped through Fan Cheng International Transportation Services Company (Eurasia) who appointed Admiralty Logistics & Purchasing Limited as the local consolidator in Nigeria in respect of the container which contained the appellant’s cargo. The consolidator was contracted to clear the container through Customs, transfer the container to a warehouse, unstuffed the container, and deliver the appellant’s goods to it at the warehouse. The container arrived at the port but Admiralty Logistics & Purchasing Limited was unable to clear the container as a result of which demurrage accrued.
