Facts:

The plaintiff/respondent, Samotech Limited and the defendant/appellant, Zenith Plastics Industry Ltd entered into a contract for the respondent to construct an 11 KVA electric power line at a cost of N1,405,500 (one million, four hundred and five thousand five hundred naira). The respondent completed the construction of the 11KVA electric power line and demanded payment from the appellant but to no avail.
