By an Amended Statement of claim dated 25/9/96, the Appellant claimed at the lower Court against the 1st and 2nd Respondents jointly and severally the following reliefs:
1. The sum of N1,000,000.00 (One Million naira) being the loss and/or damages suffered by the plaintiff flowing directly from the 1st and 2nd Defendants’ infringement of Plaintiff copyright; and
2. “An injunction against the 1st and 2nd Defendants, whether by themselves, agents, servants, employee or privies, from further copying, reproducing and/or publishing any part of the book known as the “Street Maps of Lagos” without first obtaining the licence or permission of the Plaintiff.”
Parties filed and exchanged pleadings, called witnesses and tendered documentary exhibits at the trial. After parties closed their case, the lower Court on 18/12/2001 delivered its judgment and dismissed the Appellant’s suit on the ground that it had no copyright which the Respondents infringed.
Dissatisfied with the decision of the lower Court, the appellant appealed to the Court of Appeal.
