Facts:

The claimant filed a writ of summons on 31st January 2002 together with a statement of claim the sum of N2,087,251.00 plus 21% interest per annum from the 5th day of June, 2001 to the date of judgment and thereafter at the rate of 7½ percent per annum till full liquidation of the total sum. The defendant filed a statement of defence, dated 28th February 2002, on 4th March 2002 and denied any liability to the plaintiff’s claim.

The claimant company was contracted to renovate the defendant’s new offices and warehouse at Oshodi Industrial Layout. The claimant got the two contracts by tendering quotation with a list of breakdown of work to be carried out. The list was substantially approved by Micheal Ademola Ayinde, Managing Director of the defendant company.
