Facts:

The four respondents, Ekeoha, Opara, Eguzode and Amako filed in the High Court of Rivers State a writ of summons with a statement of claim against the appellant, Port Harcourt City Local Government Council for the sum of N65,000,000.00 (sixty five million naira) representing special and general damages for the destruction by the appellant of the 72 market stalls built by the respondents which was a breech of agreement between the parties.
