Description

The Appellant commenced the action by Originating Summons after notifying PENGASSAN of an intra-union dispute and requesting the Minister of Labour and Productivity (2nd Respondent) to invoke his powers under the Trade Disputes Act by appointing a conciliator or taking other statutory steps.

While the suit was pending, the 2nd Respondent convened a meeting between the Appellant and PENGASSAN, but the dispute remained unresolved. The 2nd Respondent subsequently filed a Counter-Affidavit and Written Address out of time, while the 1st Respondent filed no process. The Appellant thereafter filed a Further Affidavit and Reply on Points of Law.
