This action was commenced at the Sagamu Division of the High court of Ogun state, wherein the Cross-Petitioner sought an order dismissing the Petitioner’s petition, as well as a dissolution of the marriage between the Petitioner and the Respondent on the ground that the marriage has broken down irretrievably in that the Petitioner has since the marriage behaved in such a way that the Respondent cannot reasonably be expected to live with her.
Upon exchange of pleadings between parties, the matter proceeded to trial in the course of which only the Cross-Petitioner testified after which the Cross-Respondent’s Counsel, informed the Court that the Cross-Respondent was not calling any witness and rested her case on that of the Cross-Petitioner.
Upon consideration of the pleadings of both parties, the evidence put forth by the Cross-Petitioner, and the submissions of Counsel on both sides, the court per Coram Okunsokan, J, granted the reliefs as sought by the Cross-Petitioner and in such wise dissolved the marriage between the parties.
