Description

The Appellant, who was the Applicant before the lower Court, instituted the proceedings by an Originating Motion dated 29 August 2016, challenging the PND restriction placed on its account No. 10103486559 maintained with the Respondent. The Appellant sought, inter alia, declarations that the placement of the PND restriction without a valid and subsisting order of Court was unlawful and constituted a violation of its right to the enjoyment of property under Section 44 of the 1999 Constitution (as amended) and Article 14 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act.
