Facts:

The Appellant, as Plaintiff, sought the following reliefs against the Respondent, as Defendant in the High Court of Lagos State for:

(i) The sum of ₦779,910.00 (Seven Hundred and Seventy-Nine Thousand Nine Hundred and Ten Naira only) being the outstanding money owed by the Defendant to the plaintiff representing the value of palm kernel and PK Seeds supplied to the Defendant between the month of May 1996 and August 1996 and which still remains unpaid till date.

(ii) Interest at the rate of 21% per annum from the month of August 1996 until judgment and thereafter at the rate of 6 until the entire debt is liquidated.

The Respondent denied the claim and joined Issues with the appellant vide its Amended Statement of Defence. The appellant also filed a Reply to the Statement of Defence. At the conclusion of the trial and after considering the written addresses of the parties, the learned trial Judge dismissed the Appellant’s claim.

Dissatisfied with the decision of the trial Court, The Appellant appealed to the court below, which also dismissed the Appellant’s appeal.

The appellant still aggrieved further appealed to the Supreme Court.
