The appellant filed an action against the respondent at the High Court of Lagos State. The appellant sued for the sum of N73,241,564.25k (Seventy Three Million, Two Hundred and Fifty One Thousand, Five Hundred and Sixty Four Naira, Twenty-Five Kobo) on the allegation that the respondent unlawfully charged the appellant excessive interest on its current account. The appellant also sued for interest on the above sum at the rate of 30% per annum.

The trial court dismissed the claim of the appellant on the ground that the originating process was signed by an unknown person. The appellant was aggrieved by the decision of the trial court and filed a Notice of Appeal at the Court of Appeal, Lagos Division praying it to set aside the trial court’s judgment and remit the case back to the trial court for trial de novo.
