Facts:

The respondent Mr. Amaikom was a customer of the appellan, Lion Bank of Nigeria Limited at its Kano branch and operated savings account in his name. He was also the alter ego and prime mover of a company called Josachs (W. A) Company Limited. The respondnet was also the sole signatory to the company’s current account with the appellant at the same branch in Kano. The account of the said Josachs (W.A) Company Limited with appellant was overdrawn and in a bid to liquidate the said indebtedness, cheques were issued by the company which the respondent signed but which were returned unpaid.
