Facts:

The appellants/applicants filed an application before the Court of Appeal seeking inter alia extension of time within which to appeal an interlocutory decision of the lower court. The application was filed 4 months after the lower Court had given its ruling and the appellants were outside the statutory period within which to appeal hence the application before the Court of Appeal.
