Facts:

This is an appeal against the judgment of the National Industrial Court (trial Court), Lagos Judicial Division which was delivered on 6th July 2017 by Hon. Justice J.D. Peters.

The Appellant (as Claimant in the trial Court) who was an employee of the Respondent (as Defendant in the trial Court), by a Complaint accompanied with a Statement of Claim and other process, sought among other declarations that the termination of his appointment by the Respondent was null and void, and amounted to unlawfulness. His reason was premised on the ground that his employment with the Respondent was terminated without due cause or notice, and without an opportunity, for him to be heard.

The Respondent through its Statement of Defence alleged the unruly behaviour of the Appellant and his recalcitrant nature even after being issued a query in respect of the same, and this was what led to his employment termination.

At the conclusion of the trial, both counsels addressed the court, and in a considered judgment the learned trial Judge dismissed the Appellant’s case and refused his claims, but granted the sum of N121,333.33 to the Appellant as terminal benefits as admitted by the Respondent.

Dissatisfied with the judgment of the trial court, the Appellant appealed to the Court of Appeal.
