On the Ruling of the National Industrial Court of Nigeria (the lower Court), the Central Bank of Nigeria, (3rd Respondent) filed a Notice of Preliminary objection in its capacity as Garnishee, for an order striking out the Garnishee proceedings. The lower Court dismissed the notice of Preliminary objection and went on to make its earlier Garnishee order nisi, absolute. The lower Court, having made the Garnishee order absolute, ordered the Garnishee, that is the 3rd Respondent to immediately pay the sum of ₦113,187,123.00 (One Hundred and Thirteen Million, One hundred and Eighty-Seven Thousand, One Hundred and Twenty-Three Naira) to Mrs Kehinde Dunmoye, the Judgment Creditor and 1st Respondent in this appeal. Dissatisfied with the Ruling, African Prudential Registrars Plc, the 2nd Judgment debtor before the lower Court and the Appellant in this appeal filed a Notice of Appeal in which it challenged the Ruling of the lower court.
