Wema Bank Plc v. Folorunso

The respondent was a customer of National Bank of (Nig) Ltd (‘NBN’) which was acquired by the appellant. He claimed that sometime in 1982, he took an overdraft facility from the appellant and deposited his title document as collateral. He further alleged that he has settled his indebtedness with NBN before it ceased operation in 1992 and that since then, all attempts to secure the release of his title document failed.
