Union Petroleum Services Ltd v. Petredec Ltd

The respondent instituted an action for breach of contract against the appellant in the High Court of Justice, Queens Bench Division, England. The appellant entered appearance and took steps in the proceedings. However, both parties resolved to settle amicably and therefore entered their terms of settlement as the judgment of the court.

The English court entered judgment against the appellant as contained in the terms of settlement.

Subsequently, the respondent registered the judgment in the High Court of Lagos State. The appellant brought an application to set aside the registration.

The High Court dismissed the appellant’s application. Aggrieved, the appellant appealed to the Court of Appeal.
