UBA Plc v. Udusip

The respondent is a member of an unregistered union called the Afaha Ebughu Development Union. In January 2006, the respondent’s union lodged an upcountry cheque of N50,000.00 (Fifty Thousand Naira) in its account with the appellant. The following month, some of its members accused the trustees of being corrupt for having purportedly withdrawn the said N50,000.00 without authorization. The trustees visited the Surulere branch of the appellant and demanded a copy of the union’s Statement of Account. The statement revealed that on 13 February 2006, the appellant reversed the payment of N50,000.00 (Fifty Thousand Naira) on the ground that the upcountry cheque was returned unpaid.
