R-Benkay Nig. Ltd v. Cadbury Nig. Plc.

The respondent appointed the appellant as a transporter and the parties entered into a contract which provided that the appellant would safely and securely transport goods on behalf of the respondent. The respondent alleged that some goods were delivered to the appellant for onward delivery to a client but that the appellant lost the goods in transit and thereby failed to deliver the consignment to the consignee. The respondent further alleged that in breach of their agreement, the appellant did not possess a valid and current Goods-in-Transit Insurance Policy. Due to the foregoing, the respondent detained the appellant’s trailer.
