NIMASA & Anor. v. Hensmor Nigeria Ltd.

The 1st appellant is an agency of the Federal Government of Nigeria responsible
for maritime safety in Nigeria, the 2nd appellant is an officer of the 1st appellant. The 5 respondent is the registered owner of a vessel known as M.T. AGBOMIEN (“the vessel”).The respondent alleged that in March 2006, the vessel which was loaded with 1,500 metrics tons of Dual Purpose Kerosene (DPK) was conveying the product from the Nigerian National Petroleum Corporation (NNPC) offshore depot to Apapa, Lagos when the master of the vessel raised an alarm asserting leakage of kerosene on board the vessel which led to a request for Nigerian Port Authority’s (NPA) urgent clearance to enable it berth and discharge at Warri Jetty.
