Nigerian Bottling Company Plc v. Ubani

The respondent is a cocoa merchant and the owner of the property at 55, Obudu Road, Ikom, Cross River State comprising a vast warehouse. The respondent who had left Nigeria in 1990 for the United Kingdom alleged that in 1994 he secured a contract to supply 1500 tonnes of fermented Nigerian Cocoa beans to a company in the United Kingdom and decided to return to Nigeria to make use of his warehouse. However, upon returning to Nigeria, he discovered that the appellant had taken over his warehouse since 1991 without prior authorization. Despite repeated demands to the appellant to vacate the warehouse or pay compensation, the appellant continued to trespass on his property. He therefore instituted an action against the appellant for trespass.
