First Bank of Nigeria PLC v. Akiri

The respondent, a customer of the appellant, alleged that the appellant either negligently or recklessly honoured a cheque which he issued to a third party for the sum of N500,000 (Five Hundred Thousand Naira) contrary to the mandate given to it.

He instituted an action at the Ondo State High Court claiming N500,000 (Five Hundred Thousand Naira) for negligence, recklessness and total disregard for his mandate by the appellant and N2,000,000 (Two Million Naira) as general damages for the appellant’s negligence/recklessness.
