Emirates Airlines v. Aforka & Anor

The appellant is an international air carrier based in Dubai, United Arab Emirates. The respondents purchased ink cartridges from Dubai through their agent who arranged for the goods to be transported by air to the respondents in Nigeria through the appellant.
The consignment was never delivered to the respondents and they commenced an action against the appellant alleging negligence and breach of contract and claiming AED362,775.00 (Three Hundred and Sixty Two Thousand Seven Hundred and Seventy Five Dirhams) being the cost of the ink cartridges and the freight fee. They also claimed N2,500,000.00 (Two Million Five Hundred Thousand Naira) as their solicitor’s fees.
