British Airways v. Atoyebi

The respondent was a first class passenger on the appellant’s flight from London Heathrow Airport to Murtala Mohammed Airport Ikeja, Lagos. At the boarding gate in London, a member of the appellant’s staff informed the respondent that one of the pieces of hand luggage he intended to take onto the flight was too bulky and in excess of the permitted weight. He handed the bag to the appellant’s staff to be checked into the aircraft’s hold. The bag was tagged and the respondent was given a tag. His bag however did not arrive in Lagos. The bag was never returned to him in Lagos even though he had been informed that it had been traced at Heathrow and would be sent to Lagos without delay. The bag was not sent and the respondent was constrained to travel back to London with a business class ticket to retrieve his bag.
