Adeniyi v. Ejigbo Local Government

The appellant was an employee of the respondent and prior to his dismissal was assigned to the Primary Health Care Unit of the respondent as a payment voucher clerk.

The respondent alleged that the appellant defrauded it of N527,189.44k (Five Hundred and Twenty Seven Thousand One Hundred and Eighty Nine Naira, Forty Four Kobo) by manipulating payment vouchers and illegally collecting salaries of some staff. It therefore issued the appellant a query and set up a panel of inquiry to investigate the allegations.

The respondent also laid a complaint of stealing against the appellant and five others and the police commenced the prosecution of the appellant and the others at the Chief Magistrate Court in Ejigbo. The respondent later formally withdrew the charges against them.
